1.1 You will be able to access most areas of this website without registering your details with us.
1.2 We may revise these terms and conditions at any time by updating this posting. You should check this website from time to time to review the current terms and conditions. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this website.
2.1 You are deemed to place an order with us by ordering via our secure online checkout process. Payment is in UK sterling (GBP) and can be made by most major credit/debit cards. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgment, detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we dispatch the order. When we dispatch the order, the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order with us.
2.3 We may refuse to accept an order: (a) where goods are not available; (b) where we cannot obtain authorisation for your payment; (c) if there has been a pricing or product description error; (d) if you do not meet any eligibility criteria set out in our terms and conditions.
3.1 All prices are in UK sterling and include VAT at the current rates, with the exception of Rhino commercial vehicle roof rack systems where prices are shown exclusive of VAT.
3.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown in our Delivery Policy found elsewhere on this website.
3.3 Our prices are reviewed periodically.
3.4 In most instances orders will be shipped directly from our warehouse in Kent. However, occasionally larger special order items such as Thule car rooftop tents and Rhino van rack systems will be shipped directly to the customer from the manufacturer. This normally does not extend the quoted delivery time.
3.5 Items shown on this website as being "In Stock" means that they are normally physically in stock in our warehouse.
4.1 If you wish to cancel your order:
(a) you must notify us in writing by letter or by email to support@roofracks.co.uk
(b) where goods have already been dispatched to you, by returning the goods to us in accordance with clauses 4.2 to 4.11 below.
4.2 As per our Returns Policy you can return unused goods, in new condition that you have ordered from us, for any reason, at any time within 14 days after the day the goods are received for a full refund or exchange. The costs of returning goods, unless faulty, damaged or incorrectly supplied by us, shall be borne by the purchaser. Returned items must be returned in undamaged original packaging.
4.3 Upon receipt of the goods, we will give a full refund of the amount paid, less any outward carriage charges or an exchange or credit as required. If the goods returned are not received by us in (a) their original packaged condition, (b) damaged, (c) misused, (d) show obvious signs of use or with (e) parts missing, we reserve the right to make an appropriate deduction from the original purchase price.
4.4 The rights to return the goods to us as referred to in clause 4.3 will not apply in the following circumstances: - in the event that the product has been used or is not in resalable condition as a new product.
4.5 Unless the goods have been incorrectly supplied, defective or damaged on delivery, the cost of returning items is the responsibility of the purchaser.
4.6 If the reason for return is that the goods are either defective or incorrectly supplied due to a mistake on our part, we will arrange for the goods to be collected/swapped over at our expense, or if agreed with ourselves in advance, for smaller items we will refund the standard rate return postage.
4.7 Items returned after fourteen days from the day after receipt of goods may be subject to a handling/restocking charge.
4.8 Please note that before any goods can be returned you must contact us and receive a return number.
4.9 Any item returned must be packaged in their original packaging and packed securely in the same way that they were sent in order to avoid damage in transit. If the goods arrive with us in a damaged state due to improperly packaging it will be deemed to be the responsibility of the customer. We must be notified by telephone or email within one working day of the signed receipt of delivery of any items that were received damaged. In such cases the items must be signed for as "item(s) received damaged". No liability for loss or damage will be met by ourselves for consignments delivered without a signature if the customer has specifically requested that the goods could be left without obtaining a signature. If any parts are missing from the order, please notify us by telephone or email within 7 working days of signed receipt of the goods.
4.10 Returned Special Order items are subject to a 30% handling and restocking charge.
4.11 Please be aware that the cost of arranging collection or swapping over of items by our carriers is often more expensive than the original cost of delivery. If the supplied goods were received as one package, and our carriers are collecting, the goods must also be returned as one package otherwise a surcharge to cover the additional carriage will be applied.
4.12 Should we substitute goods from those ordered due to unavailability of the product, and they are unacceptable, we will pay the costs of returning the items.
The provisions of clauses 4.4 to 4.11 do not affect your statutory rights.
5.1 While we endeavour to ensure that the information on this website is correct, we do not warrant the accuracy and completeness of the material on this website. We may make changes to the material on this website, or to the products and prices described in it, at any time without notice. The material on this website may be out of date, and we make no commitment to update such material.
5.2 The material on this website is provided “as is” without any conditions, warranties or other terms of any kind. 6.2 Nothing in these terms and conditions shall exclude or limit our liability for (i) death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under applicable law.
6.3 If your use of material on this website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.
6.4 You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this website, or the use by any other person using your registration details.
7.1 These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts. None of the above affects your consumer statutory rights.
